Patent infringement cases arise under Federal patent law over which the Federal courts have exclusive jurisdiction. See § 1338(a) of Title 28 of The United States Code.

Current Patent Law

Patent Act of 1952, 35 U.S.C. §§ 1-376 (2000), July 19, 1952, ch. 950, Pub. L. No. 82-593, 66 Stat. 792.

Eases the standard for patentability, abolished the requirement that invention occur in a “flash of creative genius”, made patents presumptively valid, defined the term process to include new uses of old inventions, and delineated and eased the patent misuse/contributory infringement standards.
